Contents:

Third party in the dispute

  • Development of conflict third parties; presence of third parties justifies conflict third parties
  • Importance of imaginations by conflict parties about potential third parties
  • Conflict argumentation = competition for third parties

Competition for third place:

  • With the judging third party: How can the judge be persuaded to make a particular legal decision?
  • With the mediating third party: Even in front of mediators, you don't want to appear stupid or unseemly.

Escalations in mediation:

  • Interaction crisis or proof of trust
  • Breakout behaviour from the third-guarded convention is only permitted to a limited extent.
  • Meeting policing tasks

Interim conclusion: The – perceived as neutral – presence of a third party is decisive and all methods should be selected in such a way that they do not jeopardise this neutrality.

Services of sociological observation of mediation:

  • Systematisation offers for mediative phenomena
  • Sharpening a realistic view of your own activities
  • Mitigation of consequential problems that arise or would arise from self-idealisations
