Commentary on Section 18 of the Consumer Dispute Resolution Act (VSBG)<\/h1>\n

The new edition of the commentary on the Consumer Dispute Resolution Act – with our commentary on \u00a7 18 VSBG (use of mediation in consumer dispute resolution)\u00a0<\/strong>– has been available since May 2021.<\/p>\n

It is still disputed to what extent mediation within the meaning of the VSBG differs from „pure mediation“ within the meaning of the Mediation Act, if at all. I would like to take this opportunity to thank my esteemed colleague Peter R\u00f6themeyer (commentary in the Nomos commentary on the VSBG) for the stimulating dispute on the question of a so-called \"pure mediation\". This book is more than a legal commentary. It can rather be described as a compendium of consumer dispute resolution, as it not only explains the individual provisions of the VSBG, but also provides a comprehensive overview of this area of law, from the basic principles of European law to the regulations in other countries and the procedural rules of individual arbitration boards to sample forms from the Federal Office of Justice. It also analyses practical experience with the VSBG, which has not yet been able to achieve the significance it was intended to have due to the pronounced refusal of the entrepreneurial side. The fact that the team of authors is made up of practitioners and academics means that the work not only provides competent answers to individual questions, but also a well-founded discussion of fundamental issues relating to consumer arbitration.<\/p>\n<\/div><\/div><\/div>
