Da sind die trennungswilligen Eltern, die sich anhand von gelesenen Gerichtsurteilen dar\u00fcber streiten, wer welche Zahlungen zu leisten hat. Das sind die ehemaligen Kooperationspartner eines Softwareprojektes, das gescheitert ist und sich diese Personen mit ihren Anw\u00e4lten ma\u00dfgeblich \u00fcber rechtliche Einsch\u00e4tzungen und Folgewirkungen unterhalten, wer noch was zu leisten hat und wer nicht. Und da ist der Betriebsrat eines schwer angeschlagenen Industriebetriebes, der sich scheinbar kaum um wirtschaftliche Fragestellungen schert, aber die wirtschaftliche Schieflage zum Anlass nimmt, \u00fcber die Rechtswidrigkeiten und Ungeheuerlichkeiten der Gesch\u00e4ftsleitung und F\u00fchrungskr\u00e4fte reden m\u00f6chte und Vers\u00e4umnisse vorwirft. Konflikte werden rechtlich ausgetragen und das l\u00e4sst sich leicht erkl\u00e4ren, denn wer Recht hat und andere ins Unrecht setzt, kann Anspr\u00fcche ableiten und das haben wir fr\u00fchzeitig gelernt. Das ist so intuitiv richtig, dass selbst Mediatoren nichts Besseres einf\u00e4llt, als das Recht an sich und Rechtsanw\u00e4lte als solche am liebsten aus dem Mediationsverfahren zu verbannen. Sie empfinden das Recht und die Rechtsvertreter schlichtweg als st\u00f6rend und meinen, man m\u00fcsse das Recht aus der Mediation und damit aus der Konfliktbearbeitung einfach auch mal heraushalten, weil es wie ein Elefant im Porzellanladen daherkommt. N\u00e4mlich die richtige. Und im Konflikt am besten f\u00fcr die Konfliktparteien gemeinsam. Doch was ist die richtige Entscheidung? Und nun kommt das Recht zum Tragen. Denn um rechtlich zu argumentieren, muss man nicht Jura studieren. Und im Jurastudium lernen Studenten sehr schnell, dass sie ihr Rechtsgef\u00fchl zu beanspruchen haben und das dann am besten auch zu professionalisieren haben. Aber rechtliche Argumentation selbst, das lernen wir alle von Kindesbeinen an. Wir denken fr\u00fchzeitig in richtig und falsch, in rechtm\u00e4\u00dfig und unrechtm\u00e4\u00dfig, auch wenn uns der Ma\u00dfstab egal ist und es noch lange nicht um staatliche Gesetze geht. Auf der einen Seite der Linie befindet sich das Recht oder derjenige, der Recht hat. und auf der anderen Seite der Linie befindet man sich pl\u00f6tzlich im Unrecht. Recht kann nicht geschaffen werden, ohne Unrecht mitzudeklarieren. Und wer will schon im Unrecht bleiben? Richtig, niemand. Und wer sich im Unrecht wehnt, wird rechtlich argumentieren, dass er noch auf der Seite des Rechts steht. Und will er nur behaupten, dass er auch auf der Seite des Rechts steht, behauptet er doch zugleich auch mit, wer Unrecht hat. Schaut man sich diese Linie des Rechts an, kommt das Recht wie eine Leitlinie daher, wie ein Leitseil, das nicht nur in die Zukunft weist, sondern klar verteilt, wer hat Recht und wer hat Unrecht. Und das Recht ist eine wichtige Kategorie in dieser Entscheidungsfindung, denn die Entscheidung muss rechtm\u00e4\u00dfig sein. Aber wer zu nah am Recht ist, erkennt nur das Recht als Leitseil, als Leitlinie der Entscheidung, die auch Unrecht in den Blick nimmt. Erst mit Abstand erkennen wir, dass das Recht eine Spielwiese er\u00f6ffnet, einen Rahmen setzt, innerhalb dessen die Konfliktparteien sich als freie B\u00fcrger in einer freien Gesellschaft frei bewegen k\u00f6nnen. Und ich sprach davon, dass die Konfliktparteien auch noch weitere Kriterien haben. Die Konfliktentscheidung muss bezahlbar sein. Nicht bezahlbare L\u00f6sungen sind keine L\u00f6sungen.
